How a group of LGBTQ students from IITs is taking up the fight against Section 377

The legal fight to de-criminalise homosexuality that started in 2001 with a petition by the Naz foundation has seen many twists and turns. In 2009, the Delhi High Court stated that section 377 was violative of human rights. However, in late 2012, the Supreme Court overturned this judgment upholding that, the LGBT community constitutes only a small section of the country’s population.

In 2016, fresh petitions were filed in the Supreme Court. The Court’s Right to Privacy judgment of 2017 gave new hope to students who are now at the center of the fight to decriminalise homosexuality.
