Watch: Harsh Mander’s remarks that the Supreme Court has taken issue with
On Wednesday, the Supreme Court said a plea filed by Harsh Mander asking for FIRs to be filed against politicians who have made hate speeches would be heard only after it examined a speech in which the activist allegedly instigated a crowd against the top court.
In his petition, Mander named BJP leaders Kapil Mishra, Anurag Thakur and Parvesh Verma, noting they had made hate speeches in the days before communal violence broke out in Delhi last week.
“We want to clear this out, we will issue notice and till this is clarified, we will not hear you, we will hear the other petitioners,” Chief Justice SA Bobde told Mander’s counsel Karuna Nundy.
This came after Solicitor General Tushar Mehta, representing the Delhi police, filed an affidavit against Mander accusing him of making “derogatory remarks” against the apex court and demanding he be held in contempt. He referred to a video showing Mander purportedly saying, at a protest against the citizenship law, that he has no faith in the Supreme Court and that “real justice will be done on the streets”.
Subsequently, the Delhi police filed an affidavit accusing Mander of “instigating violence via a speech”, the Indian Express reported. It alleged that the activist was “known for taking contemptuous stand and bringing the judiciary, as an institution, and individual judges in disrepute”. The police urged the court to impose exemplary costs on Mander and launch contempt of court proceedings against him.
