Abhisar Sharma has approached the Supreme Court challenging the Assam police case against him and the constitutionality of section 152 of the Bharatiya Nyaya Sanhita under which it was lodged, among other sections, LiveLaw reported.
A bench of Justices MM Sundresh and N Kotiswar Singh will hear the matter on Thursday.
The independent journalist and YouTuber said the FIR was lodged over his video criticising the Assam government’s communal politics and questioning its allotment of 3,000 bighas of land for mining purposes to a private entity.
He was booked under sections 152 (endangering sovereignty of the nation), 196 (promoting enmity between different groups) and 197 (imputations prejudicial to national integration and security) of the BNS.
Newslaundry had earlier reported on the complainant in the case, which came days after two other FIRs under section 152 – one against The Wire’s founding editor Siddharth Varadarajan and another against consulting editor Karan Thapar and Varadarajan. The complainant appeared to have links to the ABVP.
